Reuters and Yahoo News are reporting that a the third circuit court of appeals overturned the FCC’s $550,000 fine on CBS who aired the nipple flash live as it happened during the Super Bowl. The court found that the ruling was, “arbitrarily and capriciously departed from its prior policy.” Essentially the court found that the FCC seemed to have changed its policy for this one situation so they threw out the fine. The FCC, not happy with the ruling, has 90 days to file a petition to review this ruling. |
